    Court dismisses motions against Shaibu’s reinstatement as Edo deputy governor

    Justice James Omotosho of the Federal High Court, Abuja on Tuesday, dismissed two separate motions challenging the reinstatement of Philip Shaibu as the state’s deputy governor.

    The motions were filed by the Edo State government and the state House of Assembly.

    The judge also awarded the cost of N200,000 each against the plaintiffs.

    The development followed an application by a lawyer to the state’s Attorney-General (AG), Marvin Omorogbe, and that of the Assembly, Sonia Egbunia, seeking to withdraw the motions for a stay of execution.

    Although Reuben Egwuaba, who appeared for Shaibu did not oppose their intention to withdraw the two motions, he, however, asked the court for a N50 million cost each against the AG and the Assembly.

    Justice Omotosho had on July 17 voided the impeachment of Shuaibu by the parliament.

    He also ordered his reinstatement as deputy governor because the Assembly failed to comply with due process in the purported impeachment.

    The judge held that the allegation on which the Assembly based the impeachment proceedings was untenable in law and did not constitute gross misconduct.

    Dissatisfied with the judgement, the government, and the Assembly filed separate motions for a stay of execution.

    The judge fixed September 24 for the hearing of the two motions.

    When the matter was called on Tuesday, Egbunia told the court that though the matter was slated for hearing, she was withdrawing the motion for stay since the matter has been taken to the Court of Appeal.
